rescheduling of tax for the taxpayer in "objective economic difficulties"

With No Judgement 20,778, filed Oct. 7, 2010, the Supreme Court affirmed the principle that the taxpayer in "objective difficulties" economic entitled to obtain from collection of taxes by installments. In particular, according to the judges the rescheduling is not an administrative proceeding and, therefore, does not constitute merely a legitimate interest of the taxpayer, but rather a right which must be assessed by the tax commission, in case of refusal of the debt
